Education - Legal Issues and Resources pertinent to children with disabilities:
Note: IDEA, Section 504, ADA, FAPE are federal laws. States have disability education laws also, however, they MUST parallel federal laws. The same applies to school district policy. States may offer more to children with disabilities than federal laws, but not less. There are some areas of IDEA that are silent, therefore, it's generally best for parents to be familiar with both federal and state laws. Federal law supercedes State law.

- IEE - Independent Educational Evaluation - OSEP
- IEE is not confined to educational type testing. There may be situations in which a child’s
educational needs are intertwined with a child’s health needs, therefore, stating that the types of evaluations conducted are only those regarding educational need does not add any useful clarity.
- If a parent requests an IEE - Section 300.502(a)(2) provides that if a parent requests an IEE
at public expense, the public agency must provide the parent with information about where an IEE may be obtained and the agency criteria applicable for IEEs. In order for an evaluation to be at public expense, Sec. 300.502(e)(1) requires that the criteria under which an IEE is obtained, including the location of the IEE and the qualifications of the examiner, be the same as the criteria that the public agency uses when it initiates an evaluation, to the extent that those criteria are consistent with a parent's right to an IEE. In addition, Sec. 300.502(e)(2) states that, except for the criteria described above, a public agency may not impose conditions or timelines related to obtaining an IEE at public expense.
